TERMS AND CONDITIONS FOR ADVERTISERS

These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights. However, we may change these Terms and Conditions at any time. Please review these Terms and Conditions regularly to ensure that you are aware of any changes.

In these Terms and Conditions:

“Advertisement” means any advertisement supplied by you for posting on the Website; and

“we”, “us”, “our” means Bright Property the website of Grange Property Services Ltd, (company number 0328539) whose registered address is Darby Grange, Lynderswood Farm, London Road, Braintree; and

“the Website” means www.brightproperty.co.uk; and “you”;

"you", “your” means any person placing an Advertisement on the Website;

By proceeding to advertise with Bright Property and making your payment, you are unconditionally agreeing to these Terms and Conditions.

1. The Website

1.1 We make no warranties or representations with regard to the availability of the Website, which may sometimes experience downtime and may not be accessible to all users at all times. However we will endeavour to make the Website available to all users at all possible times.
1.2 We disclaim to the fullest extent permitted by law all warranties, Conditions and other Terms implied by statute or common law regarding the information contained and held on the pages of the Website, save that nothing in these Terms and Conditions shall exclude or limit our liability for fraud or death or personal injury caused by our negligence.
1.3 We reserve the right to remove any Advertisement from the Website, and retain any fee paid, if we become aware that:-
1.3.1 you have not paid any outstanding fee payable to us; or
1.3.2 you have failed to comply with these Terms and Conditions; or
1.3.3 we believe that the Advertisement breaches Clause 2.1
1.4 As part of our ongoing commitment to providing a top quality Website we reserve the right to change the functionality and layout of the Website without notice.
1.5 We will provide a secure personal account through which you will have access to input, view and update any Advertisement and personal data held on the Website.
1.6 The Website does not constitute any form of legal contract or agreement between vendor and purchaser of the advertised property, nor does it form any part thereof. You should seek legal advice and services in this regard.

2. The Advertisement

2.1 By submitting your property details, you warrant to us that:-
2.1.1 you are the legal owner of the property advertised on the Website; and
2.1.2 you agree to our publishing all details and photos on the Website and/or any of its associate links; and
2.1.3 you own any copyright material in each Advertisement, or, if you are submitting any third party copyright material, you have such third party’s full and written consent; and
2.1.4 you shall at all times be fully liable and held responsible for the content of each Advertisement on the Website or any associate websites; and
2.1.5 you will provide true, accurate, complete, up to date and relevant information for any Advertisement, and that no Advertisement will be misleading or in breach of any regulatory or legal requirement in any way; and
2.1.6 you accept full and unconditional liability in the event of any Advertisement’s content breaching these Terms and Conditions or those of any associated website where such Advertisement may be viewed.
2.2 You may alter or delete any part of any Advertisement at any time.
2.3 You will set your own selling or rental price.
2.4 You may feature one property in each Advertisement on the Website and will be charged for any additional properties entered under a single Advertisement.
2.5 We will endeavour to advertise your property for the agreed period but reserve all rights to delete or remove any Advertisement at our discretion without giving prior notice to or receiving consent from you if its content breaches our or one of our associate’s Terms and Conditions, or the content is offensive, derogatory or defamatory in any way or the content infringes any privacy right, contractual right, trademarks, copyrights or other intellectual property right of a third party.
2.6 We reserve the right to decline at our sole discretion any application for an Advertisement to be placed on the Website.
2.7 At the end of the advertising period we will automatically delete the relevant Advertisement from the Website or any other associate websites, unless a renewal fee is received in full from you.
2.8 You agree to indemnify us against any claims or expenses arising from any information placed by you on the Website.
2.9 You agree to further indemnify us against any losses we suffer as a result of your sending us material containing viruses or other files which cause damage or corruption to the Website or to our IT systems.
2.10 By submitting an Advertisement to us, you agree to assign all copyright in the Advertisement to us and agree to waive all moral rights in relation to the Advertisement.
2.11 We accept no liability for any Advertisements not received by us or received in a corrupted form, for any time the Website is not operational, or for any Advertisements containing errors or being factually inaccurate. We will not be liable to you in contract in tort or otherwise for any loss or profits, business, revenue, opportunity, goodwill or anticipated savings nor for any indirect consequential or economic loss arising out of your use of the Website.
2.12 If, notwithstanding the provisions of these Terms and Conditions purporting to exclude or limit or liability, we are found liable to you then our total liability to you in contract tort or otherwise arising in connection with your use of the Website shall be limited to the return of any sums paid by you in relation to the Advertisement.

3. Our Service

3.1 We are not obliged to check or amend any Advertisement and we accept no responsibility or liability for it.
3.2 We will not arrange any viewings or negotiate the sale or rental of any property advertised on the Website. You are fully responsible for and agree to promptly answer and reply to all buyer enquiries and to promptly arrange and conduct all viewings.
3.3 We do not offer any guarantee or warranty with regard to a successful advertising campaign.
3.4 We may subcontract any of our obligations under these Terms and Conditions. We accept no liability for any loss or damage arising from any act or omission of our sub-contractors.
3.5 If you sell your property during the term of the contract please notify us so we can remove your property from our database.
3.6 Entry into this contract will not prevent you selling or advertising your property through an estate agency or other sales medium.
3.7 If you have previously signed a sole rights agreement with an Estate Agent, it is your responsibility to seek independent advice with regard to the Terms and condition you have previously agreed to.
3.8 We accept no liability in the event of an Estate Agent enforcing its contractual obligations.
3.9 We retain all title/interest in any intellectual property relating to the Website including any copyright in the Website and all trademarks.

4. Pricing and Payment Terms

4.1 We reserve the right to amend our pricing structure without notice.
4.2 All prices and charges on this Website are in UK pounds.
4.3 Payment must be received in full, via our online payment system or via another method as agreed with us in writing, prior to the provision of your selected service. All fees are subject to VAT at the standard rate.

5. Returns and Refunds Policy

5.1 You have the right to cancel the order for an Advertisement within 24 hours from placing it. You must notify Bright Property by telephone or e-mail (01245 360715) or e-mail info@brightproperty.co.uk) of your intention to cancel within 24 hours from placing your order. No returns or refunds can or will be made later than 24 hours after you have placed your order. Subject to written authorisation by a director of Grange Property Services Limited, you will be refunded the full invoice amount less costs incurred by us for internet publication, and costs involved in the production of goods that are made special order to customer specification, and any other such costs that may have been incurred by us in the provision of the service.
5.2 We reserve the right to cancel your account without refund if:
5.2.1 you place any material of an unlawful objectionable or obscene nature on the Website;
5.2.2 you falsify details with the intent to mislead or defraud;
5.2.3 you include other site URL’s within your account on the Website without our written authority.
5.3 It is advisable to not include personal or confidential information which you do not wish the public to see unless this is contact information.

6. For Sale/To Let Boards

6.1 We will use reasonable endeavours to send your “For Sale or “To Let” boards within 10 working days from the date you place your order.
6.2 Our liability and responsibility for the delivery and use of the For Sale or To Let board and its contents ends when we pass the “For Sale and “To Let” board to the courier or postal service who will deliver the package to you.
6.3 You are responsible for the use of your “For Sale” or “To Let” board once it is received by you.
6.4 You must assemble your own “For Sale” or “To Let” board in conjunction with your local authority’s planning regulations.

7. Security

7.1 The purpose of the Website is to expose properties for sale or let to the wide and growing internet audience. Whilst we will use all reasonable means to protect Website security, we do not warrant this. Please contact us immediately if you become aware of any outside interference with your account. You should ensure that you keep your login details securely protected.
7.2 To protect your account, your password is encrypted using the latest in security technology and cannot be accessed by any person, if you forget your password please email us in the forgotten password box which can be located on the login page. To further protect your account we strongly advise that you close your browser after using the Website. This will safely terminate your sessions.

11. General

11.1 These Terms and Conditions shall be interpreted in accordance with English law and you and we irrevocably agree to submit to the exclusive jurisdiction of the English courts in respect of any dispute or claim arising out of or in connection with these Terms and Conditions.
11.2 No failure by us to exercise any of our rights under these Terms and Conditions shall operate as a waiver of such rights.
11.3 The contract formed under these Terms and Conditions is not intended to benefit any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 and no third party shall have any right to enforce any provisions of the contract.
11.4 You may not assign, sub-contract or delegate your rights or obligations under the contract formed under these Terms and Conditions without our prior written consent.
11.5 If any provision or part of a provision of the contract formed under these Terms and Conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, in restraint of trade or otherwise unenforceable it shall to the extent of such illegality, invalidity, restraint of trade or unenforceability be deemed severable and the remaining provisions of the contract shall continue in full force and effect.
11.6 The contract formed under these Terms and Conditions shall constitute the entire agreement between the parties in relation to its subject matter.
11.7 Nothing in the contract formed under these Terms and Conditions is intended to or shall operate to create a partnership or joint venture of any kind between the parties or to authorise either party to act as agent for the other, and neither party shall have authority to act in the name of or on behalf of or otherwise to bind the other in any way.
